Welcome to the Sounds of Nikud website (“the site”). The site is operated by Sugar Sweet Apps (“we”, “the site operator”, or “Sugar Sweet Apps”).
These terms govern the use of the site and the services offered through it. The site includes learning content and activities, some of which are free and some of which may be offered for a fee, as well as a referral service to independent private tutors.
Use of the site is subject to these terms and to our Privacy Policy. A particular service may also be subject to additional details, terms, or instructions shown on the service page or before purchase or registration. Those specific terms form part of the agreement for that service.
If these general terms conflict with the terms of a particular service that were clearly shown to the user before purchase or registration, the specific terms prevail for that service only, subject to any law.
By using the site you agree to these terms. Where a purchase, registration, tutor request, or other action requires explicit approval, you will be asked to accept the terms in an appropriate way.
If you do not agree to these terms, do not use the site or the relevant service.
This English version is provided for convenience. If it differs from the Hebrew version, the Hebrew version prevails.
1. Services on the site
The site is intended to support learning and practice and may include, among other things, activities related to letters, nikud, reading, numbers, arithmetic, and other subjects.
Some content and services are free, and some may be offered for a fee, with registration, or on other terms. A service that requires payment will be clearly marked as such in advance.
The services, their scope, access period, price, payment method, and any other material commercial term will be shown, as relevant, on the service page or during the purchase process before the user commits to them.
The fact that content or a service appears on the site does not guarantee that it will continue to be offered in the same way or free of charge in the future.
The learning content on the site is intended for enrichment, practice, and learning support. It is not a learning, psychological, or medical assessment, treatment, individual professional advice, or a substitute for teaching tailored to a particular student’s needs.
2. Use by children
Much of the site’s content is intended for children.
We recommend that children use the site under the guidance of a parent, guardian, teacher, or other responsible adult, according to the child’s age and the nature of the activity.
Actions involving a purchase, registration that requires personal information, contacting the site operator, or sending a request for a private tutor must be carried out by an adult.
A request for a tutor for a minor must be sent by that minor’s parent or guardian.
3. Accounts and registration
Some services may require registration or an account in the future.
If a service requires an account, the user agrees to provide accurate, up-to-date details and to keep the account’s access details confidential.
We may take reasonable measures to protect an account or the site where there is a concern about unauthorised use, fraud, a breach of these terms, or harm to the security of the service.
4. Paid services
From time to time the site may offer services, content, plans, or features for a fee.
These terms do not list all the services offered, their prices, or their features. The relevant information for each paid service will be shown to the user before purchase.
Before a purchase is completed, details such as the nature of the service, the final price, what is included, the payment method, and other material terms will be shown, as relevant.
If a renewing paid service or subscription is offered, the fact that it renews, the billing frequency, and how to stop it will be shown clearly before joining.
The price shown to consumers will be the final price payable as required by law, including taxes and mandatory charges that apply to the transaction, if any.
Payment
Payment for services purchased directly from Sugar Sweet Apps will be made through an external payment or card-processing platform. The site itself does not collect or store payment-method details.
An invoice, receipt, or other appropriate document will be issued as required by law.
Cancellation and refunds
The right to cancel, the cancellation procedure, and refunds for a paid service will follow the Israeli Consumer Protection Law, 5741–1981, the regulations under it, and any other binding law.
Where required by law, the relevant terms and ways to cancel will also be shown on or near the purchase page.
Where a transaction can be made through the site, it will be possible to give notice of cancellation online in the way the law requires, to the extent those provisions apply to the transaction.
Nothing in these terms limits a right of cancellation or refund that cannot be waived under the law.
Discontinuing a paid service
Purchasing a paid service on the site means purchasing access to a digital service, not a product that remains in the user’s possession. Access exists for as long as the service is active.
We do not undertake that any particular service will be offered or remain available indefinitely. We may discontinue a paid service, including for business, technological, or operational reasons. For an ongoing service or subscription, we will give reasonable advance notice where possible, and no charges will be made for the period after it is discontinued.
5. Private tutor referral service
The site allows parents and guardians who want online private lessons for their children to send a request for a referral to a private tutor.
Nature of the service
Sugar Sweet Apps provides a referral and connection service between parents and independent private tutors.
Sugar Sweet Apps does not give the private lessons itself and is not a party to any agreement for teaching services made between the parent and the tutor.
The tutor is an independent service provider and is not an employee, partner, agent, or representative of Sugar Sweet Apps, and is not authorised to make commitments on behalf of Sugar Sweet Apps.
After receiving the request details, we may pass them to a tutor we believe may suit the request, so that the tutor can contact the parent.
The tutor may accept or decline a request, and the parent may decide whether to engage the tutor. Sending a request on the site does not oblige the parent to buy a lesson and does not oblige a tutor to accept a student.
We do not guarantee that an available tutor will be found for every request.
Tutor checks
Tutors taking part in the referral service are required to identify themselves to us and to show us a teaching certificate.
These requirements help us operate the referral service, but they are not a promise that a particular tutor will suit the needs, character, or learning level of a particular child, and they are not a promise of any particular learning outcome.
The decision whether to engage a particular tutor remains with the parent.
Lesson price and terms
The lesson price, session length, terms for individual or group lessons, discounts, and other relevant terms are shown in the tutor request form on the site.
Where VAT applies to the tutor’s services, it is included in the price shown.
We may update the prices and terms shown for new requests in the future.
The engagement with the tutor
If the parent and the tutor agree to hold lessons, the agreement for teaching services is between them.
Payment for lessons is made directly to the tutor and not to Sugar Sweet Apps.
The tutor is responsible for collecting payment and for issuing an invoice, receipt, or other document as the law requires of the tutor.
The payment method, lesson times, changes, cancellations, late arrivals, and refunds relating to the lessons themselves will be arranged between the parent and the tutor, subject to the terms shown as part of the service and to the parties’ rights under the law.
Sugar Sweet Apps does not hold lesson payments for the tutor and is not a party to the payment arrangement between the tutor and the parent.
Online lessons
Lessons through the referral service are intended to take place online using a communication tool agreed between the parent and the tutor.
The parent is responsible for making sure the child has suitable equipment and a suitable connection, and that the lesson platform is used safely.
A parent or responsible adult should be available as needed during a minor’s lesson, especially at the start of the relationship with a new tutor.
Use of Zoom, Google Meet, or another external service, if used, may also be subject to that provider’s terms and privacy policy.
Feedback and complaints
We welcome feedback about tutors to whom a referral was made.
If a problem arises with a tutor, and in particular a concern about inappropriate behaviour towards a child, please contact us promptly.
We may look into a complaint, ask for more information, pause new referrals to the tutor, or end the tutor’s participation in the referral service, according to the circumstances and at our discretion.
If there is an immediate concern for a child’s wellbeing or safety, please also contact the emergency services or the appropriate authority.
6. Information in a tutor request
For the referral service we ask the parent to provide the details needed to handle the request, such as contact details and information relevant to matching a tutor.
Providing the information is voluntary. Without the required details we may not be able to handle the request or refer it to a tutor.
By sending the request, the parent understands that, to handle it, we will pass the contact details and the relevant information in the request to a suitable tutor, so that the tutor can review the request and contact the parent.
Please avoid providing information that is not needed to find a tutor, in particular payment-method details, passwords, or sensitive information that the request does not require.
How information is collected, used, kept, and passed on, and users’ rights regarding it, are described in the site’s Privacy Policy.
Where we collect personal information through a form, the notice required by law will also be shown.
7. Contact and communication
When a user sends us a request, enquiry, or form, we may contact the user using the details provided in order to handle it, including by email or phone.
As part of the referral service, the tutor to whom the request was passed may also contact the parent to handle the request and possibly arrange lessons.
Communication needed to handle a request, provide a service, or give information about an engagement does not in itself mean consent to receive advertising.
Advertising will be sent only in accordance with the law and where the required consent has been given.
8. Licence to use the site
Subject to these terms, we grant the user a limited, personal, non-exclusive, revocable, and non-commercial permission to use the site and its content for learning, teaching, and ordinary personal use.
When a paid service is purchased, the permission to use it is access to the digital service, within the scope and on the terms shown at purchase, and it exists for as long as the service is active.
Purchasing a service or using the site does not transfer ownership of any intellectual property rights in the site or its content.
9. Intellectual property
Unless stated otherwise, the rights in the site and its original content, including the design, code, site structure, texts, exercises, graphics, recordings, marks, images, and visual assets, belong to Sugar Sweet Apps or to the relevant rights holders.
Protected content may not be copied, published, distributed, sold, made available to the public, adapted into derivative works, or used systematically for commercial purposes without permission, except as expressly allowed by these terms or by law.
This does not prevent fair use or any other use permitted by law.
Third-party names, marks, products, and content remain the property of their respective rights holders.
10. Prohibited use
The site must not be used in a way that may harm the site, other users, or a third party. Among other things, you must not:
- try to gain unauthorised access to systems, servers, accounts, or information;
- bypass security mechanisms or measures designed to restrict access;
- introduce malicious code, viruses, or components that may harm the site or its users;
- run bots, crawlers, or automated requests at a volume that places unusual load on the site without permission;
- use the forms for harassment, impersonation, fraud, or sending false information;
- send a tutor request on behalf of another person without proper authorisation;
- send tutor requests without a genuine need, or misuse the details of tutors or users;
- submit through the site any content that is unlawful, threatening, misleading, offensive, or infringes another person’s rights;
- systematically collect information from the site or about its users without permission;
- use the site contrary to any law.
11. Content accuracy and external technologies
We make an effort to keep the learning content high-quality and accurate, but there may be errors, inaccuracies, or differences in presentation or pronunciation.
Some audio or pronunciation content may rely on the speech capabilities of the device, the browser, or another technology service. As a result, there may be differences between devices, voices, or operating systems.
Do not rely on the site as the only source for a significant learning matter or where professional adaptation for a particular student is needed.

12. Third-party services and links
The site may use or link to third-party services, including payment, hosting, video, communication, analytics, or other technology services.
Use of a third-party service may be subject to that third party’s terms and privacy policy.
We do not fully control the availability, policies, or operation of external services and, subject to the law, we are not responsible for a fault or change that originates in a service outside our control.
13. Privacy and information security
The use of personal information on the site is governed by our Privacy Policy, which forms an integral part of these terms.
We act in accordance with the applicable law on information protection and security and take reasonable measures appropriate to the nature of the information and the service.
No technological system is completely immune to faults or security incidents, so we cannot guarantee absolute security.

14. Site availability and changes
We work to keep the site available, but we do not guarantee that it will be available without interruption, free of errors, or on every device and browser.
We may correct, update, improve, replace, add, suspend, or remove content and features on the site.
For a service that has been paid for, section 4 above also applies.
15. Limitation of liability
Subject to any law, use of the free content on the site is at the user’s own responsibility.
Sugar Sweet Apps does not promise that using the site’s content will lead to any particular learning improvement, grade, or result.
In the tutor referral service, Sugar Sweet Apps provides the connection and referral service and does not provide the teaching itself. We do not guarantee the availability of a particular tutor, a tutor’s suitability for every student, or any result achieved in the lessons.
Sugar Sweet Apps connects a tutor with a parent who wants private lessons, and is not a party to the relationship between them beyond that initial connection.
16. Suspension or termination of use
We may restrict or end access to a service in the case of unlawful use, misuse, an attempt to harm the site, fraud, impersonation, or a material breach of these terms.
Where the circumstances allow, we will act proportionately, taking into account the nature of the breach and the service concerned.
17. Updates to these terms
We may update these terms when the site, the services, the way the business operates, or the law changes.
The date of the latest update will be shown at the top of the page.
If a material change affects an ongoing service, we will give notice in a reasonable way, according to the circumstances and the law.
18. Governing law and jurisdiction
These terms and the use of the site are governed by the laws of the State of Israel.
The competent courts in the Tel Aviv–Jaffa district have exclusive jurisdiction over any matter relating to these terms or to the use of the site.
19. General provisions
If any provision of these terms is found to be invalid or unenforceable, this will not, as far as possible, affect the validity of the other provisions.
If Sugar Sweet Apps does not exercise a right in a particular case, this is not a waiver of that right in another case.
